If you have property, you may qualify for cell tower leasing. You may wonder what exactly is cell tower leasing? It is a type of property contract which takes place between a telecom company and the owner of the land where the cell tower is installed. Telecom companies are always seeking property where they can install another cell tower. In addition to high raise buildings, they look for rural areas. This is one way to earn some extra income by entering into a cell tower lease.

A land owner who is likely to be approached by a telecom company desirous of erecting a cell tower, should first be aware of the laws as well as the regulations that govern the lease even before he is approached by a buyer. The land owner needs to check out certain factors before he grants the lease. These factors include that the terrain should be evaluated for its suitability for the purpose. The local ordinances pertaining to the property, security concerns and more importantly whether the carrier has given the company the requisite authorization all need to be checked.

There are property owner's rights that need to be discussed along with a variety of other issues. Generally property owners have certain rights concerning the land even after it is turned over to the company installing the cell tower. Hence it the property owner's responsibility to ensure that he or she is fully aware of the rights that would be transferred to the operator, the rights that would remain with him and also the areas where his permission are required.

Before entering into a contract to lease the land for a cell tower it is important to evaluate the land to check out and be sure of the rent that it would fetch. The cell tower rates depend on various factors. These factors pertain to whether the land is in an urban, rural or suburban area, the market value of the land and the background of the building. At times the position of the building in terms of zoning also affects the price or the rent rates.

Ascertaining the rate of cell tower leasing is indeed a difficult task as there is no single source of information which would provide the owner with the entire database relevant for deciding on the price. However, there are some organizations which have managed to accumulate information and build database over a period of time and getting in touch with them would enable the owner to acquire an accurate estimate of the lease.

The period of the lease is very important to the land owner as well as the leasing company when they sign the lease. The lease could either be for a full term period of about 20 to 25 years, or it could be for a five year period after which the agreement could be renegotiated when the contract is being renewed.

Even though the carrier or the company may have permission to visit the leasing site as and when he desires, but he cannot use the facilities pertaining to the property which are not accessible for him and nor can he occupy an area larger than the designated one, even though it might just be an inch more. He would have the right to maintain or construct the cell tower, but by no means should these activities affect the activities of the property.

When the building has been leased for cell tower, the law states that the lease is immune to the sale of the property at a future date and the land owner can dispose it off if he so wishes.
